Alex Manderstam Ltd. (“we,” “us,” “our,” “Company”) offers online content and support available for purchase in the form of The Next Big Thing, an online program (“Program”), and other digital products and services. By completing your purchase, you are consenting to these Terms and Conditions, which govern your use of and access to our website, the Program, other digital products, and any services provided by Alex Manderstam Ltd.

1. Definitions
The terms “we,” “us,” “our,” and “Company” refer to Alex Manderstam Ltd.
The terms “user,” “you,” and “your” refer to site visitors, customers, and any other purchasers of our Products.
The term “Content” includes, but is not limited to, the Site, information contained on the Site, our materials/information, Products, services, any digital content delivered or downloaded via email or other electronic means, webinars, courses, classes, live posts, and the like, whether purchased or not.
The terms “Product” and “Products” include, but are not limited to, materials, resources, or information provided to you by us in our digital products, courses, services, or any digital content or information delivered or downloaded via email or other electronic means, webinars, documents, programs, courses, classes, PDFs, video calls, live posts, and the like.
2. Acceptance of Terms and Conditions
By purchasing any Product or Program from the Company, you agree to abide by these Terms and Conditions in their entirety. If you do not agree to these terms, you should not purchase our products or services. We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our platform/course hosting platform/website. It is your responsibility to check the appropriate page periodically for changes. Your continued use of or access to the digital course/product following the posting of any changes constitutes acceptance of those changes.

3. Purchase Terms and Payment Policy
3.1 General Payment Terms: Full payment is required at the time of order placement for non-subscription purchases before granting access to the course or Product.

3.2 Refund Policy: Due to the digital nature of our products, we do not offer refunds after purchase unless explicitly stated or authorized by Alex Manderstam Ltd. If you are not satisfied with your purchase, please share your concerns with us via email at support@alexmanderstam.com, and we will do our best to make things right. Eligible courses may have a 30-day refund period, subject to proof of attempt and failure to achieve results following course strategies.

3.3 Payment Plans: If you have selected a payment plan option, you agree that all payments are to be made on time. If there is a delay in payment, the Company reserves the right to bill you a late fee of 3% each week, based on the remaining balance due under the payment plan. You remain responsible for any remaining payments in the payment plan, regardless of any attempt to request a refund or terminate your purchase after accessing the product(s).

3.4 Chargeback and Fees: You agree not to initiate chargebacks. You are liable for fees associated with recouping payment and any collection fees for unpaid amounts. We reserve the right to forward any payment disputes to a collection agency.

3.5 Authorization and Cancellation: Alex Manderstam Ltd. reserves the right to refuse or cancel suspected unauthorized or fraudulent orders.

4. Account Creation
In order to use the Service/Site, you may be required to provide information about yourself, including your name, email address, username, password, and other personal information. You agree that any registration information you give to Alex Manderstam Ltd. will always be accurate, correct, and up to date. You may not share your password or login information with anyone. Any violation of these terms is grounds for removal and banishment from the site at our discretion. No refunds, partial or otherwise, will be provided in this type of situation.

5. No Guarantees
Participation in this Program or use of any Product does not guarantee specific outcomes or results. Success depends on individual effort, commitment, and abilities. Alex Manderstam Ltd. cannot guarantee specific results, and testimonials are not promises or guarantees of success. Any testimonials or reviews shared by the Company are not a representation of guaranteed results, only possible results. The user not achieving their desired results is not grounds for a refund, partial or otherwise.

6. Success Guarantee
The Program is backed by a “Success Guarantee.” Although The Next Big Thing is a 3-month program, under this guarantee, the Program guarantees to work with clients until they have enrolled at least 1 paying client into their signature program they created as a result of the Program, provided that:

The client has created and launched their program following the guidance inside the Program by 31/12/2024.
The client is following all the strategies and guidance provided by the Program.
The client is able to provide their work and assignments.
The client attends a minimum of 2 live
calls per month and/or submits coaching requests or progress check-ins a minimum of 2 times a month for the duration of the Program.

If the client has launched their program and failed to enroll at least 1 paying client, the client will receive continual and ongoing guidance until they enroll at least 1 paying client into their program. In essence, the client must demonstrate full participation to not only ensure their success but also in the event that they need to receive ongoing guidance.

7. Marketing
You agree that Alex Manderstam Ltd. may refer to the relationship between you and the company and use, publish, amend, and create derivative works with your images, feedback, and comments made available on various platforms for marketing purposes.

8. Content Usage
All Content, such as text, data, graphics files, videos, sound files, and other materials contained in the Site or provided through the Program or Products, are copyrighted unless otherwise noted and are the property of the Company and/or a supplier to the Company. You agree not to distribute, copy, forward, or share the product content with any third party. Any violations will be legally pursued to the fullest extent permitted by law by Alex Manderstam Ltd. No such materials may be used except as provided in these Terms of Use.

9. Third-Party Links and Content
9.1 Affiliate Links: The Product or Program may contain affiliate links to or content from third parties not owned by us. The company may benefit from these links monetarily. Our inclusion of such links/content is not an endorsement, and we make no representations regarding any third-party websites or their content.

9.2 Third-Party Terms: Accessing third-party content is subject to their own Terms and Conditions and Privacy Policy, and no intellectual property rights in any third-party content are transferred to you upon purchasing any Products from the Company.

9.3 Liability: Alex Manderstam Ltd. has no control over third-party websites and their content, and you agree we are not responsible for any issues arising from your access to such sites.

10. Limitation of Liability
Alex Manderstam Ltd. is not responsible or liable for any damages received directly or indirectly from purchasing and participating in any Products or the Program. We do not assume liability for damages, injuries, harm, death, or misuse due to any act, or failure to act, by you.

11. Confidentiality
Please refrain from sending Alex Manderstam Ltd. and its representatives any confidential information. If there is a private group environment included in your purchase (for example, Circle), you understand and agree not to publish any information in any such community with any expectation of privacy or confidentiality.

12. Earnings Disclaimer
Any earnings or income/financial claims or examples shown on our Site, Product, and/or Services are only estimates of what is possible now or in the future. We make no income/financial claims or guarantees of any kind regarding financial outcomes or potential income based on your use of our Site, Products, and/or Services (or our affiliate program). We make no guarantees that you will earn any money using any of our Content, Products, and/or Services and your income or earnings are solely dependent on your actions or non-actions.

13. Severability
If any provision of these Terms is illegal, invalid, or unenforceable, it will not affect the validity and enforceability of the remaining provisions.

14. Entire Agreement
These Terms contain the entire agreement between you and Alex Manderstam Ltd. There are no other promises or conditions in any other agreement, whether oral or written.

15. Choice of Law + Venue
These Terms are governed by the laws of London, UK.

16. Miscellaneous
Please ensure that all information submitted is correct and up to date. Alex Manderstam Ltd. is not responsible for any issues arising from incorrect or outdated information provided at the time of purchase.
